Kyle Zaleski Vizuals Photography Services - Terms and Conditions

Scope of Work:
The client agrees that Kyle Zaleski Vizuals will provide real estate photography services as outlined in the
agreed-upon project proposal or service agreement.

Payment Terms:
Payment is due upon receipt of the final photographs. Kyle Zaleski Vizuals accepts payments via credit/debit, check, cash, online payment. For bookings over $500.00, a 20% deposit is required to secure the booking, with the remaining balance due on or before the delivery of final images.

Late Payments:
Invoices not paid within 30 days of the invoice date will incur a late fee of $10.00 per day. Continued non-payment will result in further actions including, but not limited to, cessation of ongoing work and legal proceedings.

Cancellation Policy:
Cancellations must be made 72hrs prior to the scheduled shoot time. Cancellations made after this period will incur a fee of 50% of the booking fee.

Rescheduling:
Rescheduling a shoot is subject to availability and must be done 72hrs prior to the shoot. Kyle Zaleski Vizuals reserves the right to charge a rescheduling fee of 5% of the booking fee.
​
Delivery of Images:
Final images will be delivered to the client in digital format via email using a digital file sharing service within 48hrs following the shoot unless specified otherwise.
​
Usage Rights:
The client will have non-exclusive, non-transferable rights to use the photographs for all marketing and promotional purposes related to their business. Kyle Zaleski Vizuals retains ownership of the images and the right to use them for promotional purposes.

Liability:
Kyle Zaleski Vizuals is not liable for any loss or damage arising from the client's use of the photography service. Liability for any damage or loss, either direct or consequential, arising from a failure to render services is limited to a refund of payments received.
​
Force Majeure:
Neither party shall be liable for any failure to perform its obligations where such failure results from any cause beyond the party's reasonable control.
​
Amendments:
Any changes to these terms must be in writing and signed by both parties.
​
Governing Law:
These terms and conditions shall be governed by and construed in accordance with the laws of California.
